Terms of Use

These Terms of Use ("Terms") are an agreement between you and the developer of BellyCue ("we", "us", "the Developer") and govern your use of the BellyCue iOS application (the "App"). By downloading, installing, or using BellyCue, you agree to these Terms. If you don't agree, please don't use the App.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use BellyCue. If you are under 18, you should have a parent or guardian's permission. BellyCue is not directed at children under 13.

2. The service

BellyCue is a personal wellness and tracking tool that helps you log meals, symptoms, bowel movements, and mood, and uses statistical analysis to surface possible food triggers. It requires no account — your logs are stored locally on your device, as described in our Privacy Policy.

4. Subscriptions & free trial

BellyCue offers a 3-day free trial, after which access continues as an auto-renewing subscription ("BellyCue Pro") billed through your Apple ID at the price shown in the App at the time of purchase (currently $5.99/month or $49.99/year).

• Payment is charged to your Apple ID account at confirmation of purchase, and at the end of the free trial unless you cancel at least 24 hours before the trial ends.
• Subscriptions automatically renew for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription anytime in your device's Settings → Apple ID → Subscriptions. Cancelling deactivates auto-renewal but does not refund the current period.
• Refunds are handled by Apple in accordance with Apple's own policies — we do not have the ability to issue refunds directly.
• Prices may vary by region and are set within App Store Connect; the price shown in the App at the time of purchase controls.

5. Your content & AI processing

You retain all rights to the meals, notes, and photos you log ("Your Content"). To provide food recognition, BellyCue sends the meal text or photo you submit to a third-party AI service solely to return a list of likely foods; this data is not retained by us and is not used to train models on our behalf. See our Privacy Policy for details. You're responsible for making sure you have the right to submit any photo you log.

6. Acceptable use

You agree not to: use the App for any unlawful purpose; attempt to reverse-engineer, decompile, or disrupt the App or its backend services; abuse, overload, or scrape the AI parsing service; or use the App in any way that could harm us, other users, or third parties.

7. Intellectual property

BellyCue, the Cue mascot and character designs, the app name, logo, and all associated content and artwork are owned by the Developer and protected by copyright and trademark law. These Terms don't grant you any rights to our trademarks or branding beyond using the App as intended.

8. Third-party services & Apple's terms

Your use of the App is also subject to Apple's Licensed Application End User License Agreement (the "Standard EULA") to the extent applicable, and to Apple's own App Store terms for purchases and subscriptions. Any AI provider used for meal parsing processes requests under its own terms.

9. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the App will be uninterrupted, error-free, or that its trigger analysis will be accurate for your specific situation.

10. Limitation of liability

To the fullest extent permitted by law, the Developer will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including any health-related decisions made based on information shown in the App. Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months before the claim arose.

11. Termination

You may stop using the App and delete it at any time. We may suspend or discontinue any part of the service (for example, the AI parsing backend) at our discretion, with reasonable efforts to avoid disrupting active subscriptions.

12. Disputes & governing law

If a disagreement comes up, please contact us first at dkov.dev@gmail.com — most things can be sorted out directly. These Terms are governed by the laws of the jurisdiction in which the Developer is established, without regard to conflict-of-law principles, except where Apple's Standard EULA applies to your purchase.

13. Changes to these Terms

We may update these Terms from time to time; the "Last updated" date above will change accordingly. Continuing to use the App after changes take effect means you accept the updated Terms.
